TERMS OF USE
Please read these Terms of Use carefully before using this mobile application (hereinafter referred to as the “Application”).
All natural and legal persons who access the Application or benefit in any way from the services provided through the Application (hereinafter referred to as the “User”) shall be deemed to have accepted these Terms of Use.
Definitions
The following terms used in these Terms of Use shall have the meanings set forth below:
• User: Natural or legal persons who visit, view, use the Application, or benefit from any services provided through the Application.
• StoneArchive: Stoneline Yapı Ürünleri Sanayi Anonim Şirketi, the owner of the Application, and the provider of all content and services offered through the Application, acting in the capacity of data controller.
• Application: Mobile software applications downloadable to smart devices and operated by StoneArchive.
Scope of the Terms of Use
• The User acknowledges, declares, and undertakes to act in compliance with these Terms of Use and all applicable legislation by visiting the Application or using any services.
• All intellectual and industrial property rights related to all content, services, designs, and software provided on the Application belong to StoneArchive. The User may not reproduce, distribute, copy, or use such content for commercial purposes without StoneArchive’s prior written consent.
• StoneArchive reserves the right to unilaterally modify, restrict, suspend, or completely discontinue the services and content provided on the Application at any time.
• The User undertakes not to perform any act contrary to applicable laws and not to violate the rights of third parties while accessing and using the Application.
• StoneArchive shall not be held liable for interruptions, data loss, or suspension of services arising from technical malfunctions or third-party interventions during the use of the Application.
Scope of Services
StoneArchive makes every effort to ensure the accuracy and timeliness of the content available on the Application. However, the information, documents, and content provided on the Application reflect the situation as of the time they are published and may differ from the actual situation over time.
Therefore, no express or implied warranty is provided regarding the currency, accuracy, completeness, suitability for a particular purpose, or performance of the information on the Application, and StoneArchive makes no commitment in this respect.
StoneArchive is fully entitled to determine the scope and nature of the services and content provided through the Application. Any changes made within this scope shall become effective as of the time they are published on the Application.
In order to benefit from certain services offered on the Application, Users may be required to meet criteria to be determined by StoneArchive and announced in the relevant sections of the Application. StoneArchive is fully authorized to determine and update such criteria.
General Provisions
StoneArchive takes the necessary technical and administrative measures within the framework of all applicable regulations, particularly personal data protection legislation, and makes its best effort to ensure that the information, documents, or downloadable content available on the Application are free of harmful software. However, no guarantee is provided that the Application is completely free from viruses, trojans, malware, or similar harmful elements.
It is the User’s responsibility to take the necessary software, hardware, and security precautions to prevent damages that may arise from such harmful software. StoneArchive shall not be held liable under any circumstances for data loss or damages that may occur due to the use of the Application or technical problems caused by third parties.
Any risks and damages that may arise from third-party websites/applications or content accessed through the Application or via redirections from the Application shall be the User’s responsibility, and StoneArchive assumes no liability in this regard.
All software, visual and audio content, databases, designs, logos, trademarks, trade names, domain names, and all other elements within the Application are the property of StoneArchive or are used under license obtained from the relevant right holders. These elements are protected under the Law No. 5846 on Intellectual and Artistic Works, the Law No. 6769 on Industrial Property, and other applicable legislation. The User may not copy, reproduce, distribute, or use such content for commercial purposes without StoneArchive’s prior written consent.
Protection of Personal Data
StoneArchive processes personal data shared by Users through the Application in accordance with the Law No. 6698 on the Protection of Personal Data (“KVKK”) and relevant secondary legislation. Detailed information regarding personal data can be accessed through the Information Notice available within the Application.
By using the Application, the User acknowledges that they have read and understood the provisions regarding the processing of personal data and that they have provided the necessary approvals and consents within the scope of KVKK.
Limitation of Liability
StoneArchive reserves the right to modify, update, temporarily or permanently suspend the Application and/or its content at any time. Accordingly, StoneArchive shall have no liability for any damages that may occur to the User or third parties.
StoneArchive shall not be liable for any damages arising from interruption, delay, error, data loss, unauthorized access, or similar issues that may occur during the use of the Application. By using the Application, the User acknowledges and accepts this.
Governing Law and Jurisdiction
These Terms of Use are governed by the laws of the Republic of Türkiye. In the event of any disputes arising from the Application, the Bakırköy Courts and Enforcement Offices shall have jurisdiction.
Effectiveness and Acceptance
These Terms of Use enter into force as of the date they are published on the Application. By accessing or continuing to use the Application, the User shall be deemed to have accepted these Terms.
StoneArchive may amend this text if deemed necessary. Amendments shall enter into force as of the time they are published on the Application.
